StockPitt LLC (“Service Provider”) operates the Moments App, which enables users to upload, create, and share user-generated content (UGC). StockPitt LLC respects the intellectual property rights of others and expects all of our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we respond promptly to valid claims of copyright infringement and maintain a policy for terminating repeat infringers.

Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been used or uploaded on our platform without authorization, you may submit a DMCA Takedown Notice to our Copyright Agent. Your notice must include the following:

To report infringement, send a notice to our Designated Copyright Agent including:

1. Your electronic signature
2. Identification of the copyrighted work you claim has been infringed
3. Identification and location of the material you believe is infringing (such as the username of the uploader, screenshot, or in-app location).
4. Your contact information, including name, address, telephone number, and email
5. Statement of good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
6. Statement under penalty of perjury that information is accurate and that you are authorized to act on behalf of the copyright owner

Counter-Notifications

If you believe your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:

1. Your electronic signature
2. Identification of the material that was removed or disabled, including it prior location
3. Your contact information
4. A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification 
5. A statement consenting to the jurisdiction of the appropriate Federal District Court and agreeing to accept service of process from the original complainant 

Upon receiving a valid counter-notification, we may restore the content unless the original complainant files a court action within the timeframe required by law. 

Repeat Infringers

We may terminate accounts of users who repeatedly infringe the intellectual property rights of others. We also reserve the right to remove or disable access to content that we reasonably believe may infringe copyright, even without a formal DMCA notice.
